El-rufai Sues Reno Omokri, Chidi Odinkalu, Thisday Newspaper Elobah For N1.Billion Defamation


Kaduna State Governor, Nasir El-Rufai has filed a N1.5 billion defamation suit against former presidential spokesperson Reno Omokri, Professor Chidi Odinkalu and others joined in the defamation lawsuit filed by his lawyer A.U. Mustapha (SAN) before the FCT High Court are Thisday Newspaper, Daniel Elombah, Elombah Communications, Barrister Joseph Onu and Auta Nyada.
In the lawsuit filed against Reno Omokri, the Kaduna state Governor said the statements contained in his publication titled: ‘El-Rufai’s email saying southern women youth corpers are seen as whores’ which was published by Thisday newspaper on Sunday 14th of June 2020 is injurious to his reputation and “malicious, unwarranted and defamatory”. He demanded the sum of N500 million in damages and an apology published in the newspaper.
In the lawsuit filed against against Odinkalu, Daniel Elombah and Elombah Communications, El-Rufai averred that the publication titled: ‘Litany of 25 critics who have suffered at El-Rufai’s hands compiled by Chidi Odinkalu’ which was published in Elombah.com on Wednesday September 2, 2020 is “malicious, unlawful and without any justification.” He demanded the sum of N500 million in damages and apology for the “defamatory and greatly injurious to his reputation.”
The Kaduna state Governor who also filed a lawsuit against Joseph Onu and Nyada, insisted that a letter that they wrote dated August 19, 2020 titled: ‘Request to withdraw the offer of platform at the 2020 Annual General Conference of the Nigerian Bar Association (NBA), Malam Nasir El Rufai’ addressed to Prof. Koyinsola Ajayi, SAN, in his capacity as the Chairman, Technical Committee on Conference Planning (TCCP) Nigerian Bar Association and copied to DR. Olisa Agbakoba, SAN, Chairman, Board of Trustee, Nigerian Bar Association and Mr. Olumide Akpata, the then President-Elect of the NBA and published in the media, is “defamatory and greatly injurious to the reputation of the claimant.” He also demanded an apology and the sum of N500 million in damages.
A date for hearing is yet to be fixed.

CJ Olusiyi Receives FIDA Executives Kogi Chapter


The Chief judge of Kogi State, Hon Justice Henry Adebola Olusiyi hosted international federation of women lawyers (FIDA) Kogi State Chapter.
The Chairperson of the Association, Mrs Ajuma Lilian Okolo along with the Secretary of the Association, Barr Kemi Omaiza Usman stated that, the group were in the office of the Chief Judge to appreciate God and the Executive Governor of Kogi State, His Excellency, Alhaji Yahaya Bello, the judicial friendly Governor for the confirmation of the appointment as the substantive Chief Judge of the state, stating that, as the patron of the association, they’re delighted with the modest achievements and described the Chief Judge as one of the outstanding Chief Judge in Nigeria who believes in due process and speed administration of justice system as could be seen from the visit to correctional homes in the State in recent time and commended the Governor for the well deserve confirmation.
Responding, the Chief judge, hon Justice Henry Adebola Olusiyi thanked the association and its executive member’s for identify with him and assured them of his continued support when ever the need arise.

Kogi State House Of Assembly confirms Justice Olusiyi As Substantive Chief Judge

Kogi State House of Assembly has confirmed the appointment of Justice Henry Adebola Olusiyi as the substantive Chief Judge of the state, while Justice John Bayo Olowosegun was equally confirmed as President of Kogi State Customary Court of Appeal.
The two Judicial Officers were confirmed during the house plenary on Tuesday, after the Speaker Hon. Matthew Kolawole read a communication from the Governor, Alhaji Yahaya Bello, informing the Assembly of the recommendations by the National Judicial Commission for their appointment.
It could be recalled that, Hon. Justice Henry Adebola Olusiyi was appointed as the acting Chief Judge of the State following the sudden demise of the former office holder, Late Hon. Justice Nasiru Ajanah who died on 28th June, 2020.
Justice Olowosegun also replaced late Justice Ibrahim Shaibu Atadoga, who also died in June 2020.
The governor in the letter to the house, said Justice Olusiyi was nominated for screening and confirmation in line with section 271 (1) of the 1999 constitution as amended.
After the screening, Hon. Bello Hassan Balogun, the majority leader representing Ajaokuta State Constituency, moved a motion that Justice Olusiyi and Justice Olowosegun should take a bow and leave.
He said this was necessary in view of their track records in the administration of justice in the state. His motion was seconded by the member representing Igalamela Odolu Constituency, Barr. Cosmos Atabor.
Prince Mathew Kolawole, the Speaker, who announced the confirmation, directed the Clerk of the house to inform the governor of the confirmation.
Hon Justice Henry Adebola Olusiyi hails from Igbaruku-Okeri in Yagba West Local Government Area Kogi State, born on 11th January, 1956, and started his educational career at St. Michael’s Primary School, Kaduna from January, 1962 to December, 1966 finished his primary education at E.C.W.A Primary School, Mopa Kogi State between January, 1967 and December, 1968.
He enrolled for his secondary school at the E.C.W.A Secondary School, Mopa, Kogi State, in January, 1969 and rounded up in June 1973.
He secured admission into the prestigious Ahmadu Bello University, Zaria in July, 1974 and graduated in 1978 with an LL.B (Hons.) before proceeding to the Nigerian Law School, Lagos in October, 1978 and by July, 1979, he was called to the Nigerian Bar after successfully completing the programme of the school and obtaining his B.L.
Hon. Justice Olusiyi’s jurisprudential, administrative and managerial depth of working experience started as a state Counsel at the Ministry of Justice Maiduguri, Borno State where he had his mandatory N.Y.S.C scheme between August, 1979 and July, 1980.
He subsequently became a Magistrate Grade II in the Kwara State Judiciary, Ilorin.
He became a Magistrate Grade I and later progressed to become a Chief magistrate in July, 1980.


Justice Henry Adebola Olusiyi, Kogi State Chief Judge and Alhaji Yahaya Adoza Bello, Executive Governor of Kogi State.
He served in this position up to March 6, 1988 when he was appointed the Chief Registrar at the High Court of Justice of the Kwara State Judiciary which he resumed with at the Kogi State Judiciary, Lokoja on August 28, 1991 upon the creation of Kogi State. He was appointed a Judge of the Kogi State High Court on June 5th, 1992.
Meanwhile, the house has sworn in Hon. Atule Egbunu as the lawmaker representing Ibaji State Constituency.

Court strikes out BATN’s suit against FCCPC


The Federal High Court sitting in Lagos, on Monday, completely struck out an Originating Summons, in an action filed by British American Tobacco Nigeria (BATN), against the Federal Competition and Consumer Protection Commission (FCCPC).
BATN had asked the court to prevent FCCPC from investigating it for anti-consumer protection, public health and anti-competition violations that the Commission was investigating.
The tobacco company had, in Suit No. FHC/L/CS/1350/2020 before Justice Rilwan Aikawa, secured an ex parte injunction, and further asked the court to prevent the continuation of the investigation by the consumer protection commission.
In a preliminary objection argued by Babatunde Irukera, Executive Vice Chairman of the FCCPC, the court agreed that the case was premature and lacking in merit, as administrative conditions precedent, such as Pre-Action Notice, were not complied with by BATN.
The court noted that there was no basis or urgency for the filing of the action after the Pre-Action Notice which, according to the court, remains a fundamental provision of the law.
By this decision, the ex parte injunction expires as the court refused the case and agreed with the FCCPC that it had no jurisdiction to hear the case.
