Breaking: FHC Strike Out Case Filled by Factional APM Leader.

The Federal High Court in Abuja has ruled as an abuse of court process in a case filed by factional APM leader, Mohammed Musa Bagana and his cohorts, pending the determination of the suite at the Appeal court.

Justice Binta Nyako in a judgement delivered on Thursday, 5th January, 2023 faulted the process initiated by the appellant without recourse to the earlier one filed at the higher court.

She avered that the plea of the factional members to compel INEC into accepting their candidates for the February elections was null and void untill the Appealate court rules otherwise.

She says the appealant are not known by law, and therefore the court cannot put something on nothing.

The Judge further ruled that, the expelled former BOT Chairman, Mohammed Musa Bagana Is not even a member of the Party as His expulsion from the party on the 5th of February, 2022 is still subsisting.

His expulsion which He contested at the FCT High Court Abuja was upheld by the court and no superior court has upturned His expulsion.

He (Mohammed Musa Bagana) therefore, is not a member of the Party and consequently lack the locus standi to participate in the affairs of the party.

The Appeal court hearing comes up after the general elections coming up in February, as June 2023 was slated for continue hearing.
