Peter Adejoh brought Police to forcefully chase us from our ancestral land – Witness tells court

Hon. Abraham Uwua, on Tuesday told a Benue State High Court presided over by Justice Tertsea Kume, that a certain Peter Adejoh brought armed security men to chase them from their community and ancestral land in April 2023.

Mr Uwua who is the first plaintiff in the suit he instituted alongside Pastor Cyprian Shingule and three others on behalf of themselves and Mbachume/Ikyouv community against Mr Peter Adejoh, Engr Mike Jijjingi, the Benue State Government and two others over attempt to forcefully grab their community and ancestral land not for public but private purpose.

Testifying as the fourth witness of the plaintiffs, Hon. Uwua while under cross examination by counsel to the Benue State Government and the Ministry of Lands,Survey and Solid Minerals, Emmanuel Kpojime, Hon. Uwua told the court that it was Peter Adejoh that came with armed security men and chased them out of their land on the pretext that he had acquired the land from the BNSG.

Earlier, Hon. Uwua who was led in evidence by counsel to the plaintiffs, Doowuese Gift Adike tendered an online search Corporate Affairs Commission of Nigeria(CAC) report on BMC Homes Limited, an online extract of a Guardian Newspaper report on BMC Homes signing a contract with the Nigerian Army for mass housing and the certificate of compliance the CAC report and newspaper extract even when the matter is still pending in court. An act which is prejudicial to the final determination of the action by the court.

The trial judge, Justice Kume admitted the documents as evidence and marked them as exhibit 12,13,14 and 15.

Justice Kume thereafter adjourned the matter to July 11th, 2024, for defense of the suit.

In the suit, Mbachume and Ikyouv communities
are seeking an order of interlocutory injunction restraining Mr Peter Adejoh, Mike Jijjingi, Benue State Government and two others by themselves, their agents or anyone acting by or through them from compulsorily acquiring/taking over their ancestral land located at Tse Agbuu, Mbachugh, Utur Community of Bar council ward of Makurdi Local government area of Benue State and Ikyouv/Mbachugh, Utuurn Community, Bar council ward of Makurdi Local government area of Benue State for any private purpose order than overriding public interest.

They are also seeking monetary compensation of N500 million as general damages and N500 million as cost of litigation, amongst other reliefs.
