Concerns raised over alleged DSS plot to re-arrest ex-Nigerian attorney general Malami

The media office of Abubakar Malami, Nigeria’s former attorney general, has accused security agencies of plotting to re-arrest him immediately after his court-granted bail, prompting fears over the rule of law and his personal safety.

Malami, a senior advocate of Nigeria (SAN), was granted bail weeks ago by a High Court in the Federal Capital Territory (FCT). However, the office said the Economic and Financial Crimes Commission (EFCC) refused to release him, defying the order.

In a statement signed by Mohammed Bello Doka, Malami’s special assistant on media, the office claimed “fresh plans are underway to rearrest Malami on what are believed to be trumped-up and unrelated charges” once he is freed in the current case.

It added that Department of State Services (DSS) operatives were now surveilling Kuje Correctional Centre, where Malami is held, ready to act on the alleged plot.

“This pattern of actions, granting bail on paper while preparing fresh arrests to ensure continued detention, represents a grave assault on constitutional safeguards,” the statement said.

Malami’s team warned that his safety, and that of his family and staff, was now “under serious threat”, holding those responsible accountable for any harm.

The former attorney general “has consistently demonstrated his respect for the rule of law”, the office insisted, urging authorities, lawyers, civil society and the international community to ensure security agencies obey court orders.
